Can I Short Sale My Home?

Act 6 Notice

The preliminary step of the foreclosure process is the Act 6 Notice.  The Act 6 Notice is a letter from your mortgage company informing you that you are now in default of your obligations to them.  This letter will be sent to you after you are 30 days late.

The Act 6 Notice will include: 

  • The balance due
  • The total amount of late charges
  • A deadline for payment
  • How your ownership can be ended
  • States your right to sell the property
  • Should say that if you fail to pay the full balance, the entire amount of the mortgage will come due.

Act 91

The Act 91 Letter is the 2nd step in the foreclosure process and it is an official letter from your mortgage company that they are beginning the steps of foreclosure.  To prevent foreclosure, it is imperative for you to take action immediately.

When you receive this notice you have 30 days to meet with a counseling agency or list your home with a Certified Distressed Property Expert to prevent foreclosure.
